There isn't one best defense for every DUI. The strongest defense is the one that fits your specific facts, and it usually comes from finding the weakest link in the state's case: the stop, the arrest, or the chemical test.

Some of the most effective challenges start at the very beginning. If the officer had no lawful reason to pull you over, everything after the stop can be challenged. If the arrest wasn't backed by probable cause, that's another opening. Then comes the test itself. Breath machines fall out of calibration, officers skip the required 15-minute observation period, and blood samples get stored or handled in ways that violate California's Title 17 rules.

Other defenses attack the science. A rising blood alcohol argument questions whether your BAC was actually over 0.08% while you were driving versus later at the station. Medical conditions like acid reflux, diabetes, or a high-protein diet can throw off a breath reading. Field sobriety tests are subjective and easy to fail even sober.
